County Development Plan - Introduction
1.3 The legal basis for the Plan
This County Development Plan is the first Plan for the County to be prepared
under the Planning and Development Act 2000.
The Planning and Development Act 2000 clearly specifies those matters that
must be included in a County Development Plan, as well as matters that may
be included. Consideration can only be given to matters that relate to the
proper planning and sustainable development of the County. In summary, the
Plan must:
- Set out an overall strategy for the proper planning and sustainable
development of North Tipperary;
- Be consistent, so far as possible, with National and Regional Plans, Policies
and Strategies, which relate to proper planning and sustainable development.
A Development Plan must also include objectives for:
- The zoning of land in accordance with the proper planning and sustainable
development of these areas;
- The provision or facilitation of infrastructure, including transport,
energy and communication facilities, water supplies, waste recovery and
disposal facilities;
- The conservation and protection of the environment, including the archaeological
and natural heritage;
- The integration of the planning and sustainable development of the County
with the social, community and cultural requirements of the area and its
population;
- The preservation of the character of the landscape, including the preservation
of views and prospects, and the amenities of places and features of natural
beauty or interest;
- The protection of structures of architectural, historical, archaeological,
artistic, cultural scientific, social or technical interest;
- The preservation of the character of architectural conservation areas;
- The development and renewal of areas in need of regeneration;
- The provision of accommodation for Travellers;
- The preservation, improvement and extension of amenities and recreational
amenities;
- The provision or facilitation of the provision of services for the community
including, in particular, schools, creches and other education and childcare
facilities.
This Plan consists of a written statement and maps. The zoning maps give
a graphic representation of the proposals of the Plan and the various objectives
of the Council. They do not purport to be accurate survey maps, and should
any conflict arise between the maps and the statement, the statement shall
prevail.
The final adopted Plan replaces the Tipperary N.R. County Development Plan
1998.
