The Council Landfill at Ballaghveny is licenced for the disposal of 37,000 tonnes per annum of refuse. The enactment of the Waste Management Act 1996 put in place strict requirements in respect of the regulation of planning and management of waste in Ireland. To this end North Tipperary County Council participated in the preparation of a Waste Management Plan for the Midlands Region 2000 which was presented to the five County Councils of Laois, Longford, Westmeath, Offaly, and North Tipperary in April 1999. There is a waste management crisis both regionally and nationally, due mainly to a lack of appropriate licensed facilities, increased levels of waste production and a lack of appropriate waste management behaviour.
Any waste which is not minimised, recovered or recycled at source i.e. in the home, office, factory etc, will need to be dealt with by the provision of new waste infrastructure which will include, extended collection systems, bring sites, community recycling centres and local transfer stations, to rationalise waste collection systems.
The Waste Management Plan for the Midlands Region proposes a minimum of 39 Bring banks distributed around the County. Community Recycling Centres will be located in Nenagh, Thurles and Roscrea and will facilitate the recycling of a wide range of waste material including paper, cans, glass, timber, plastic bottles, cardboard etc. These centres may be expanded to deal with refuse trucks waste for sorting and compacting.
It was recognised in the Waste Plan that public awareness and education would be fundamental to the achievement of these objectives, and the Council recognises the importance of the planning process, particularly development control and enforcement, in securing these objectives.
Policy ENV 18: Waste Management
It is the policy of the Council to implement the policy objectives of the Waste Management Plan for the Midlands Region 2000.
Construction and demolition (C&D) waste is seen as a direct by-product of the building industry. The Council will seek to reduce the quantity of C&D waste that goes to landfill and will seek to ensure that such waste is recycled where possible. Where significant C&D waste is envisaged arising from a proposed development, the Council will seek waste management plans for the scheme as a condition of planning permission, such plans to be completed prior to the starting of development. The Waste Management Plan for the Midlands Region proposes that facilities, for dealing with C & D Waste, will be provided in Nenagh & Thurles.
Policy ENV 19: Disposing of Builders' Spoil
It is the policy of the Council to eliminate all unauthorised fly-tipping and to regulate and control the disposal of all builders' spoil and rubble arising within the County.
Policy ENV 20: Polluter Pays
It is the policy of the Council to implement the 'polluter pays' principle with particular regard to industrial and agricultural discharges, and to implement the provisions of the water pollution and environmental protection legislation and regulations thereunder.
Certain kinds of development can give rise to nuisance, which can affect occupiers of buildings, passers-by or those using outdoor space. The Council recognises that there is a need to prevent new problems from arising and to limit or reduce the nuisance from existing uses.
Policy ENV 21: Environmental Nuisance
It is the policy of the Council to resist developments that give rise to unacceptable levels of noise, smell, dust, fumes, light or noxious emissions affecting areas beyond the site boundary, or to air or water pollution. Such restrictions will particularly apply to uses sensitive to disturbances such as housing, schools and hospitals, etc.

Notwithstanding the licensing of activity under the Waste Management Act, 1996 as amended, the council will consider the impact of proposed development on environmental grounds, having regard to the proper planning and sustainable development of the area.
There has been a long history of mining in Silvermines and this has resulted in complex legal and technical issues in the rehabilitation and long term management of identified sites in the area. The Report of the Investigation into the Presence and Influence of lead in the Silvermines Area of County Tipperary (the Report) has identified these sites and has made recommendations in order to secure these sites pending formulation and implementation of long-term management plans.
The Report has stated that the Silvermines area is a safe place in which to grow up, live and work, provided that certain precautions are taken. In assessing proposals for new development within the Silvermines Study Area the Council will require that the content of the Report is taken into account and implemented where necessary.
Proposals for sites located outside of the targeted sites should involve minimal ground disturbance, and design of buildings and open spaces should take account of the guidance contained in the Report. Planning applications will be required to submit a soil analysis of lead content and all measures to comply with the recommendations of the Report.
Proposals for development within any of the identified sites will required full risk assessment, carried out by competent professionals, and include proposals for dealing with all on-site and off-site risks in accordance with theRecommendations of the Report.
