Section 70 of the 1993 Roads Act obliges landowners and occupiers of land to take all reasonable care to ensure that structures, trees, hedges and other vegetation on their land are not or could not become a danger to people using or working on a public road. Notices are issued to offenders by the council each year, usually in September/October. Under the Wildlife Act hedges are not allowed to be cut between the dates of 1 March until 31 August. Enquires are handled by the area offices or the Roads General office.
Section 76 of the 1993 Roads Act obliges landowners and occupiers of land to take all reasonable steps to ensure that water can drain off a public road onto their land and to ensure that water, soil or other materials do not escape from their land on to the road. Offenders are served a notice by the council which if not acted upon can lead to court action.
All incidences of flooding or spillage on roads should be notified to the relevant area office immediately.
The council operate a programme of winter gritting on all national routes and at particular steep gradients on the regional network.
